A. Right of Withdrawal
Introduction
Consumers have a right of withdrawal on the following terms. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither a commercial nor an independent professional activity:
Right of Withdrawal
You have the right to cancel this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last item of goods.
To exercise your right of withdrawal, you must inform us (Mixcover GmbH, Neumann-Reichardt-Str. 27-33, 22041 Hamburg, Germany, Tel.: +494098241564, E-Mail: shop@mixcover.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail). You can use the sample withdrawal form provided for this purpose, but this is not required.
To meet the withdrawal deadline, it is sufficient that you send your notification of the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse you all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a different type of delivery than the most economical standard delivery we offer), immediately and no later than fourteen days from the day on which we received your notification of withdrawal from this contract. We will use the same payment method that you used in the original transaction for this reimbursement, unless you have expressly agreed otherwise; in no case will you be charged any fees for this reimbursement. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires.
You bear the direct cost of returning the goods.
You are only liable for any loss in value of the goods if this loss of value is due to handling of the goods that is not necessary for checking the nature, characteristics and functioning of the goods.
Exclusion or Early Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the supply of goods that are not pre-made and for whose manufacture an individual selection or specification by the consumer is essential or that are clearly tailored to the consumer's personal needs.
The right of withdrawal does not apply to contracts for the supply of newspapers, magazines or illustrated publications, except for subscription contracts.
The right of withdrawal expires early in the case of contracts for the supply of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
General Notes
1) Please avoid damaging or contaminating the goods. Please return the goods to us in original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
2) Please do not return the goods to us without postage.
3) Please note that the aforementioned points 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
